GENERAL TERMS OF USE OF THE SITE

The use of the website http://www.shade-pro.it (hereinafter referred to as the “Site”) implies acceptance of these general terms by anyone who accesses and navigates it (hereinafter referred to as “User” and in the plural “Users”).

The owner of the Site is Shade Pro S.r.l. (“Shade Pro”) based in 31033 Castelfranco Veneto (TV), Via San Daniele no. 22, tax code and VAT no. 05066970269, also contactable at the ordinary email address info@shade-pro.it and at the certified email address shade_pro@legalmail.it.

User Obligations

The User must use the Site strictly in accordance with these General Terms, which can be modified by Shade Pro at any time.

Access to the internet, necessary to use the Site and all related costs and charges, including connection costs, are the User's responsibility, who must independently procure any necessary hardware or software support.

The User is solely responsible for the operation and maintenance of their own equipment and for taking all necessary measures to ensure their online safety.

The User undertakes not to use the Site and related services for illegal purposes or in a manner contrary to these terms or in ways that could damage its functionality, render it unusable, cause overload, deterioration, and/or interference with the use of it by other Users.

If the User uses the forms on the Site, they are obligated and responsible for providing truthful, correct, verifiable, and up-to-date personal data, noting that the personal data provided by the User through these forms will be processed by Shade Pro in compliance with the personal data protection regulations, for the purposes and in the manner described in the privacy notice specifically prepared for the individual forms and published on the Site so that it is easily accessible to Users.

The User declares and guarantees that they have obtained all necessary authorizations concerning any third-party data provided to Shade Pro through the forms on the Site or through any other channel.

Liability

Shade Pro is not liable, either to the User or to subjects directly or indirectly connected to the User, for damages, claims, or losses resulting from service interruptions or suspensions of the Site caused by the User, third parties, or due to force majeure or unforeseeable circumstances.

Shade Pro will not be held responsible for omissions or errors that may be contained in the materials and information transited on the Site.

The existence of a hyperlink (link) pointing to the Shade Pro Site from another third-party website, or from the Site pointing to another third-party website, does not imply approval or acceptance of responsibility by Shade Pro for the content or use of the linked sites.

Intellectual and Industrial Property

The Site and its contents are owned by Shade Pro and/or its successors and assigns and/or third parties where indicated, and are protected by the current legislation on the protection of intellectual and industrial property rights.

Unless otherwise specifically provided, all materials available on the Site (such as, but not limited to, logos, trademarks and other distinctive signs, photographs, etc.) may be used with the express authorization of Shade Pro or, if different, the holder of the rights exercisable over them; it is expressly prohibited to make any commercial use or distribution without explicit authorization.

The reproduction of the graphics and structure of the Site is prohibited. The elements constituting the Site cannot be copied or imitated. No rights are recognized to the User on the software related to the Site, including updates, and the related source codes. It is expressly forbidden for the User to carry out the activities listed in art. 64-bis L. 633/41 such as, but not limited to: extraction, reproduction, translation, adaptation, public distribution in any form, or transfer to third parties of the Software by any means, whether for a fee or free of charge. Without the express authorization of Shade Pro, it is forbidden for the User to make interventions on the Software, even for the correction of any defects and/or malfunctions, as well as duplication, decompilation, disassembly, transformation, modification of the software.

Privacy

All personal data of the User are processed by Shade Pro in compliance with the current legislation on the protection of personal data.

Applicable Law and Jurisdiction

These General Terms are governed by Italian law.

Disputes between Shade Pro and the Users related or connected to the use of the Site are subject to the Italian jurisdiction and are exclusively under the territorial jurisdiction of the Court of Treviso, without prejudice to the consumer forum, where applicable by law.
